That settlement, reached in 1997, required the government to limit the time it keeps unaccompanied minors in detention and to keep them in the least restrictive setting possible.

Trump's order included no timeline for Nielsen's department to begin detaining families together and is silent on when or how children already taken from their parents will be reunited with them. All four are 12 or older, according to Portland immigration lawyers.

When the crisis of family separations erupted at the border, GOP leaders revised the compromise bill to bolster a provision requiring parents and children to be held together in custody.

The policy moves adults to the custody of the U.S. Marshals Service and sends many children to facilities run by the Department of Health and Human Services.
