49ers' Reuben Foster charged with felony domestic violence in February incident

Reuben Foster San Francisco 49er linebacker leaves Santa Clara County Jail Sunday evening Feb. 11 2018 after being arrested on suspicion of domestic violence and possession of an assault rifle in Los Gatos San Francisco 49er and Anthem Protester Reuben Foster, Charged with Felony Domestic Violence

Foster has been scheduled for arraignment at 1:30 p.m. on Thursday, April 12 in Department 44 of the Hall of Justice in San Jose.

"Our focus is on holding accountable those who hurt their intimate partners", prosecutor Kevin Smith said.

Kevin Smith, deputy district attorney in the family violence unit, said the charges "underscore how serious we take all domestic violence in this county", noting that the Foster case is just one of almost 5,000 domestic violence cases his office handles each year.

Ian Rapoport of NFL Network stated on Thursday that he expects Foster will stay away from the 49ers' facilities until the legal process progresses.

Foster faces a misdemeanor charge of possession of a large capacity weapon magazine. "We only hope that this case illuminates the tragic regularity of the rest".

Foster has been accused of physically assaulting his live-in girlfriend, leaving her bruised and with a ruptured eardrum.

Foster was also charged with felony possession of an assault weapon and misdemeanor possession of a high-capacity magazine after officers found a Sig Sauer 516 short-barreled rifle in his home while investigating his girlfriend's domestic violence report. If convicted of all charges, he could go to prison for almost 11 years.

"The 49ers organization is aware of today's disturbing charges regarding Reuben Foster", the team said in a statement. "We will continue to follow this serious matter", the statement continues. "But if he's not doing things off the field that allow us to be able to rely on him, or he's doing something that we're not comfortable with off the field and it's proven that's what's going on - I think the guys have said then you're just going to have to move on".

Despite the charges and gruesome allegations, the 49ers appear they will not cut their 2017 first-round pick. He also was arrested in Tuscaloosa, Ala., on January 12 and charged with second-degree marijuana possession. After the charges were announced, National Football League spokesman Brian McCarthy told this news organization, "We continue to monitor all developments in this matter which is under review of the personal conduct policy". He is pictured warming up prior to a game on December 24, 2017 in Santa Clara, California.
