Stanford University sex offender Brock Turner appealing conviction

EUO 3TP Brock Turner appeals sexual assault conviction

The former Stanford University swimmer who was convicted previous year of sexually assaulting an unconscious woman - and spent only three months in jail - is appealing his convictions and requesting a new trial.

Turner's hope is that a new trial will establish innocence so that he's ultimately not forced to register as a sex offender-which is required for the rest of his life as an aspect of his sentence. However, in June 2016, Persky sentenced Turner to just six months in prison, sparking outrage across the nation.

In March 2016, Turner was found guilty of three felonies for sexually assaulting an unconscious woman outside an on-campus fraternity party last January.

The interest, which was recorded Friday, guarantees that Turner was denied of due process and charges prosecutorial unfortunate behavior as reasons he ought to get another trial, The Mercury News announced.

As Rolling Stone details, the element of the appeal centering on the assault taking place behind a dumpster argues that the description suggests Turner was trying to hide his activities.

Santa Clara County District Attorney Jeff Rosen said Friday of Turner's appeal, "Turner received a fair trial and was justly convicted".

Turner's request for a new trial hangs in part on a claim that Deputy District Attorney Alaleh Kianerci tainted the jury by incorrectly - and repeatedly - stating the sexual assault occurred behind a Dumpster.

The lawyers argue the jury did not see sufficient evidence to represent Turner's character, and that the jury was not permitted to consider a lower-level offense.

He served three months in prison for the assault before being released late a year ago.

"What we are saying that what happened is not a crime", Turner's legal adviser John Tompkins told KNTV. They further state that they do not believe what happened was a crime.

Stanford law professor Michele Dauber, who is on a committee to recall the judge who sentenced Turner, said it's common for people to appeal.

"The problem with this case wasn't that Judge Persky was unfair to Brock Turner, it was that he was unfair to the victim when he sentenced Turner to only a few months in county jail", she said. "It's not appropriate for the court of appeals to step in and retry those facts".
